Film producer and convicted sex offender Harvey Weinstein has been indicted on new charges, Manhattan prosecutors told a criminal court judge on Sept. 12.
The indictment will stay sealed until his Sept. 18 arraignment.
Weinstein, 72, didn’t attend the hearing on Sept. 12 because he was recovering from emergency surgery that he had on Sept. 9 to remove fluid from his heart and lungs.
In April, New York’s Court of Appeals overturned Weinstein’s 2020 rape conviction in a 4–3 decision, ruling that a trial judge allowed testimony that wasn’t a part of the case.
The conviction carried a 23-year sentence.
Weinstein will remain in prison, however, because he was convicted of another rape in 2022 in Los Angeles and sentenced to 16 years.
His attorneys have argued that he didn’t get a fair trial in Los Angeles, and appealed the case in June.
He’s serving time in New York’s Rikers Island jail complex while awaiting retrial.
Prosecutors who are seeking to retry Weinstein’s overturned conviction said they are investigating three more allegations dating back to the mid-2000s, including alleged assaults in 2005 and 2016 at the Tribeca Grand Hotel, now known as the Roxy Hotel.
Weinstein co-founded the film production company Miramax before launching The Weinstein Company with his brother Bob.
While at Miramax, he produced successful films such as “Pulp Fiction” and “Shakespeare in Love.”
Allegations of sexual abuse dating back to the 1970s began surfacing in 2017, sparking the #MeToo social media movement and leading to Weinstein’s expulsion from the Academy of Motion Picture Arts and Sciences.
